NCWorks Commission Policy Statements & DWS Operational Guidance

On this page, you'll find links to specific policy directives for workforce professionals in North Carolina. We display two classes of policy documents. As of November 2020, the NCWorks Commission approves major statewide policies in accordance with the federal Workforce Innovation & Opportunity Act (WIOA), and these are known as Commission Policy Statements. Meanwhile, the Division of Workforce Solutions (DWS) issues Operational Guidance notices, which carry the full authority of NCWorks Commission policies.

Commission Policy | CPS 11-2021 Eligible Training Provider Guidelines, Penalties, Appeal Process and Performance Reporting

To provide eligibility criteria, biennial certification procedures, penalties, and appeals processes for implementing Eligible Training Provider (ETP) requirements in accordance with the Workforce Innovation and Opportunity Act (WIOA) of 2014. These guidelines are applicable to providers of occupational skills training services for adults, dislocated workers, youth, and other populations as defined by WIOA Title 1-B.

Operational Guidance | OG 26-2021 Employer Accounts and Job Order Procedures

To provide protocols and procedures regarding the Division of Workforce Solutions’ (DWS) Employer Accounts and Job Orders and to rescind PS 02-2016.

This Operational Guidance has been converted from the previous DWS policy format and the procedures contained herein supersedes all previous policy, procedures, and guidelines. Minor edits have been made for clarification and consistency.

The purpose is to provide guidance that establishes the procedures regarding the use of Pseudo SSNs for performance reporting of participants enrolled in Workforce Innovation and Opportunity Act (WIOA) and Trade Adjustment Assistance (TAA) programs.

Operational Guidance | OG 24-2021 Guidance on the Provision of Workforce Innovation and Opportunity Act (WIOA) Work Experience (WEX) Opportunities

To provide Local Area Workforce Development Boards (WDBs) guidance regarding the use, documentation, and tracking of WIOA Title I funds in the provision of WEX opportunities for youth, adult, and dislocated worker participants.

 

This Operational Guidance rescinds Policy Statement PS 10-2017 and clarifies that Local Area WDBs have two years to expend current program year Title I Youth formula funds and attain a 20% expenditure rate. This Operational Guidance and the procedures herein supersede all previous policy, procedures, and guidelines regarding WEX Opportunities.

Commission Policy | CPS 05-2021 NC Job Ready Workforce Investment Grants

To transmit guidelines for the NC Job Ready Workforce Investment Grants. The Division of Workforce Solutions (DWS) will provide $1 million for the first year of the NC Job Ready Workforce Investment Grants. The DWS has developed policies and guidelines for reviewing and awarding NC Job Ready Workforce Investment Grants to Local Area Workforce Development Boards (WDBs) to participate in economic development activities and to foster the alignment of economic and workforce development, both priorities of the Workforce Innovation and Opportunity Act (WIOA) (Public Law 113-128).

Commission Policy | CPS 09-2021 Workforce Innovation and Opportunity Act (WIOA) Youth Formula Funds Expenditure Requirements

To inform Local Area Workforce Development Boards (WDBs) of the requirements to meet the mandated 20% work experience expenditure rate for local WIOA Title I Youth formula funds and the mandated expenditure rate of at least 75% for local Youth formula funds used to serve out-of-school youth, as well as to rescind PS 06-2017.
