To clarify the policymaking role of the NCWorks Commission and the operational guidance role of the NC Division of Workforce Solutions (DWS); and to adjust the official method of issuing and disseminating procedural, administrative, management, and program directions to Division staff, Local Workforce Development Boards and other interested parties.   

To establish and implement the State Workforce Innovation and Opportunity Act (WIOA) sanctions policy and appeal processes for all subrecipients of federal grant awards and state grants, where applicable, as mandated by the US Department of Labor (USDOL).

To clarify the status and use of current DWS Policy Statements during the transition of policies according to NCWorks Commission Policy Statement (CPS) 01-2020.

To transmit the N.C. Division of Workforce Solutions’ (DWS) PY 2021 Local and Regional Area Workforce Innovation and Opportunity Act (WIOA) Title I Plan Instructions.

To authorize the Division of Workforce Solutions (DWS) to administer, through Operational Guidance, the distribution of WIOA funding, on behalf of the NCWorks Commission.

To transmit guidelines for the NC Job Ready Workforce Investment Grants. The Division of Workforce Solutions (DWS) will provide $1 million for the first year of the NC Job Ready Workforce Investment Grants. The DWS has developed policies and guidelines for reviewing and awarding NC Job Ready Workforce Investment Grants to Local Area Workforce Development Boards (WDBs) to participate in economic development activities and to foster the alignment of economic and workforce development, both priorities of the Workforce Innovation and Opportunity Act (WIOA) (Public Law 113-128).

To provide Local Area Workforce Development Boards (WDBs) with guidance and procedures for NCWorks Career Center staff to follow regarding customer behaviors that violate the NCWorks Career Center Code of Conduct and for the suspension and banishment of customers from NCWorks Career Centers and to rescind PS 02-2019.

To establish and implement the Complaint System and Appeal Policy Procedures addressing Migrant and Seasonal Farm Worker (MSFW) complaints as mandated by the U.S. Department of Labor.  

The Workforce Innovation and Opportunity Act (WIOA) mandates that each State and Local Area Workforce Development Board (WDB) establish and maintain procedures for WIOA-related complaints.

To inform Local Area Workforce Development Boards (WDBs) of the requirements to meet the mandated 20% work experience expenditure rate for local WIOA Title I Youth formula funds and the mandated expenditure rate of at least 75% for local Youth formula funds used to serve out-of-school youth, as well as to rescind PS 06-2017.
